The Berlin Senate has reviewed and approved a so-called “preliminary resolution” on a significant increase in fines for unauthorized waste disposal – ranging from a cigarette butt thrown on the ground to the illegal dumping of bulky waste.
The primary goal of these measures is clear and highly relevant for Berlin – combating environmental pollution in the capital and minimizing its negative impact on citizens and ecosystems (water, soil, air). Illegal landfills, which arise in places not designated for waste disposal, pose a serious threat to ecological safety and public health.
Waste decomposition products release harmful substances into the air. Rainfall passing through waste leaches toxic compounds, leading to the contamination of surface and groundwater. Unauthorized dumping sites become sources of chemical and biological soil pollution.
According to the new fine catalog proposed by the Berlin Senate, penalties are as follows:
Illegal disposal of bulky waste (e.g., furniture, appliances) on streets or in forests will result in fines ranging from €1,500 to €11,000, depending on volume. Previously, such fines ranged from €150 to €500. If hazardous substances are involved, the fine may reach €15,000.
Dumping up to 100 kilograms of construction waste in unauthorized areas is punishable by a €25,000 fine. Larger amounts or hazardous materials (asbestos, creosote, fiberglass, etc.) carry even higher penalties.
Throwing a cigarette butt on the ground will cost €250 instead of the previous €55, while failing to clean up pet excrement will result in fines of €100 to €350. Abandoning a mattress on the roadside will cost €100, and illegally disposing of old tires €700 per tire.
Fast-food businesses with a sales area of more than 80 square meters must provide reusable cups for take-away drinks. Non-compliance will result in a fine of €750 or more.
The new fine catalog will be discussed by the Council of District Mayors of Berlin (RdB). Following this, the Berlin Senate will make the final decision on legal enforcement and implementation of the measures.
